Terms of service

These Terms of Service (“Terms”) govern your use of bklynmacs.com and purchases from [BKLYN MACS INC] (“BKLYN MACS,” “we,” “us”). By using our site or placing an order, you agree to these Terms.

1) Eligibility & accounts

You must be the age of majority in your jurisdiction to purchase. You’re responsible for your account credentials and any activity under your account.

2) Orders, pricing & availability 

All orders are offers to purchase subject to acceptance by us. We may cancel or refuse any order (for example for suspected fraud, inventory limits, or errors). Prices, promotions, and availability are subject to change. Sales tax is collected where required; you’re responsible for any additional taxes or duties.

3) Payment

We accept major cards and digital wallets via third-party processors (e.g., Shop Pay/Apple Pay/Google Pay/PayPal). Payment information is handled by these providers; please review their terms. 

4) Shipping & risk of loss

We ship nationwide to U.S. addresses. Risk of loss passes to you upon carrier’s delivery scan at the shipping address. During warmer months, we use insulation and cold packs; please retrieve packages promptly upon delivery. See our FAQ for timing and flat-rate shipping details. 

5) Perishable products: returns & refunds

Because our products are perishable, we do not offer returns, exchanges, or refunds. If there is a quality issue, damage, or an error in your order, contact us within 48 hours of delivery with photos and your order number; we’ll make it right where appropriate (replacement, partial credit, or other reasonable remedy at our discretion). This paragraph applies in addition to, and not in place of, any rights you may have under consumer law. 

6) Product info, allergens & storage

Macarons contain almonds and may contain other nuts (e.g., pistachio, hazelnut). Products are not vegan. Store chilled or frozen per the guidance on our site. Always review ingredient and allergen info before consuming. 

7) User content & acceptable use

Don’t use the site for unlawful purposes, to infringe IP rights, or to interfere with site security. If you submit content (reviews, photos, logos for custom printing), you grant us a non-exclusive license to use that content to fulfill your order and to promote our products, and you represent that you have rights to the content.

8) Intellectual property

All content on the site (brand names, logos, text, images, designs) is owned by BKLYN MACS or our licensors and protected by law. You may not copy, distribute, or create derivative works without permission.

9) Disclaimer; limitation of liability

Except as expressly stated, the site and products are provided “as is.” To the fullest extent permitted by law, BKLYN MACS and our affiliates will not be liable for indirect or consequential damages; our total liability for any claim relating to a purchase is limited to the amount you paid for that order.

10) Indemnity

You agree to indemnify and hold harmless BKLYN MACS from claims arising out of your misuse of the site or breach of these Terms.

11) Governing law; disputes

These Terms are governed by the laws of the State of New York, without regard to conflicts principles. Venue is the state or federal courts located in New York, NY. (Optional: we can convert this to binding arbitration with a small-claims carve-out if you prefer.)

12) Changes to the Terms

We may update these Terms at any time; continued use after changes means you accept the new Terms.
